The article is dedicated to a comprehensive analysis of the judicial procedure for declaring a citizen incapacitated in the Russian Federation. It examines both the substantive and procedural aspects of this institution. The key criteria for incapacity (medical and legal) established by civil legislation are explored, and the procedure for judicial proceedings is described in detail in accordance with the norms of the Civil Procedure Code of the Russian Federation.
