    The author examines current economic and legal aspects of concluding and executing independent contractor agreements; conducts a theoretical analysis of expert opinions regarding the essence of an independent contractor agreement. The concept of «independent contractor agreement» is clarified. The general features and specific characteristics of different types of independent contractor agreement and outlines future research prospects are formulated.

    Abstract:
    В статье приводятся новые разъяснения вышестоящих судов относительно норм, регулирующих институт строительного подряда в рамках гражданских правоотношений. Сохраняющиеся пробелы и неопределенности в правовом регулировании создают разносторонние судебные споры между сторонами договора и их контролирующими должностными лицами, образующие в некоторой степени казуальность правовых ситуаций. Статья направлена на систематизацию судебных решений с целью вынесения предложений по совершенствованию института.
