  • On the legal regime for major repairs at cultural heritage sites

    Abstract:
    Статья посвящена анализу правового регулирования капитального ремонта и содержания многоквартирных жилых домов, являющихся объектами культурного наследия, в контексте изменений 2023–2025 гг. Рассматриваются поправки в Жилищный кодекс РФ и Федеральный закон №73-ФЗ, исключившие капитальный ремонт общего имущества из перечня работ по сохранению объектов культурного наследия, если они не затрагивают предметы охраны. Выявлена проблема: работы по содержанию и капитальному ремонту не требуют лицензии на сохранение объектов культурного наследия, что позволяет выполнять их лицам без специальных знаний, создавая риски повреждения предметов охраны. Отмечена недостаточность контроля (осмотры памятников раз в 5 лет). Предложено включить подготовку любых проектов для объектов культурного наследия в лицензируемые виды деятельности и законодательно закрепить обязанность органов охраны обращаться в суд о восстановлении повреждённых элементов памятников.

    Abstract:
    The theoretical, methodological and legal problems of the «intangible cultural heritage» as a social phenomenon is considered as well as the foundations of state policy in relation to monuments of cultural and historical heritage are defined. It is noted that the essence of this phenomenon – the preservation of the intangible cultural heritage - should be considered in two aspects: in a narrow and broad sense of this phenomenon. In a narrow sense, the essential characteristic of the institution in question refers to cultural, ethnic, personal identity. In a broad sense, the essence of this social phenomenon implies a number of aspects: ontological, epistemological, functional, philosophical, normative (regulatory), programmed, instrumental (methodical). A well-thought-out socio-cultural policy aimed at reviving and preserving the cultural heritage should be harmoniously implemented at the federal, regional, local (municipal) levels.
