    Abstract:
    The authors of the article note the fact that modern judicial practice on compensation for damage for the illegal distribution of intellectual property objects on the Internet is characterized by a desire to unify approaches, strengthen requirements for the identification of objects of violation and expand the use of compensation mechanisms. At the same time, the authors conclude that at the moment there are still problems related to the assessment of the amount of harm, as well as the need for regulatory clarification of the criteria for calculating compensation for violations committed in the digital environment.

    Abstract:
    Статья посвящена вопросу исполнительного производства – важнейшей и неотъемлемой стадии судебного процесса. Именно она обеспечивает исполнение решения судов, которые не может или, что чаще всего происходит, не желает исполнить лицо, на которое такую обязанность возложил суд. В данный момент, к сожалению, в российском исполнительном законодательстве есть ряд проблем, из-за которых ряд ученых выдвигает позицию о том, что исполнительное производство в нашем государстве можно охарактеризовать как неэффективный институт. Это делает актуальным правовой анализ деятельности органов исполнительной власти, выявление проблем деятельности лиц, способствующих исполнению судебных актов, поиск путей дальнейшего развития законодательства.
