    Abstract:
    The article is devoted to the analysis of legal features of the regulation of surrogacy in the Russian Federation in the context of the development of assisted reproductive technologies and the transformation of family relations. The author examines the legal framework of the institution of surrogacy, which is enshrined in the Family Code of the Russian Federation and the Federal Law "On the Fundamentals of Health Care for Citizens in the Russian Federation," identifying gaps and contradictions in the current legislation. Special attention is paid to the procedure for establishing paternity in relation to a child born by a surrogate mother, the legal status of the parties to the surrogacy agreement, and the problems of implementing the child's right to origin.

    Abstract:
    Вопросы установления происхождения детей, которые рождены при использовании репродуктивной технологии (суррогатное материнство), носят актуальный характер, ведь в повседневной жизни и практической деятельности зачастую возникают проблемы правового характера, обусловленные недостаточностью юридической регламентации рассматриваемых отношений. Проблемность вопросов можно связать с различиями в позициях законодательных и судебных органов при определении приоритета прав суррогатной мамы, а также неопределенностью в вопросах взыскания алиментов, получения мер поддержки от государства. Решение указанных проблем напрямую поставлено в зависимость от установления происхождения ребенка, ведь именно его законные родители будут определять дальнейшую судьбу ребенка.

    В статье анализируются вопросы, связанные с оказанием услуг суррогатного материнства, учитывая особенности возникающих правоотношений и статуса суррогатной матери. Рассматриваются требования, предъявляемые к суррогатной матери, а также выявляются риски, с которыми сталкивается женщина, согласившаяся на процедуру имплантации эмбриона и вынашивание ребенка. Вывод делается о необходимости юридического регулирования статуса всех участников правоотношений, связанных с осуществлением права на суррогатное материнство, как обязательного элемента правового государства.

    The article examines topical issues of legal regulation of reproductive technology - surrogacy, draws attention to the imbalance of the rights of potential parents and the rights of a surrogate mother in relation to a child, emphasizes the problem of unjustified infringement of the rights of potential parents and elevation in the rights of a surrogate mother. The conducted research allowed the authors to formulate proposals aimed at improving the current legislation, which, it seems, will contribute to ensuring a balance of the rights and interests of participants in surrogacy programs, as well as the realization of the best interests of the child.
