  • The evolution of the goals of punishment in the criminal law of the Russian Federation

    Abstract:
    The chapter discusses the main goals of punishment in the Russian Federation, their significance and correlation with the principles of criminal law, as well as their role in shaping probation policy and further socialization. The article examines the changing goals of criminal punishment in the process of the formation of the Russian state: starting with the first written sources of Ancient Russia, ending with the period of the Russian Empire and the Soviet Union, with an analysis of the distinctive features and reasons for the adoption of these goals. Purpose: to conduct a historical analysis of the goals of criminal punishment, to identify the tasks they solve, to substantiate the goals in the context of the external environment, to identify common features and situations, as well as to substantiate the current goals of criminal punishment. To focus on a simplified understanding of the purpose in the form of retribution and punishment and their relationship with the aim of correcting the offender and positive consequences for the state and society. Methods: a systematic approach, historical and logical methods, analysis and synthesis, deduction, induction are used. Results: it is noted that for modern purposes of criminal punishment, retribution is practically not mentioned and is losing importance, giving way to the correction of the offender and his re-socialization. Correction and re-socialization are considered as key goals that contribute to reducing the rate of crime. If there is a real correction, the historical purpose of retribution loses its relevance and does not violate the principles of criminal law. Conclusions: over time, the concept of crime has softened, which has led to a change in the main objectives of punishment. Currently, after the adoption of the Probation Law, the focus is shifting from retribution to the correction of the convict and his re-socialization. The question of the relationship between retribution and the restoration of social justice remains the subject of scientific debate. One of the goals of probation and re-socialization is to reduce the level of recurrence of crimes. The effective use of this mechanism, combined with compliance with the principles of criminal law, contributes to the seduction of the individual without an emphasis on revenge against the criminal.

    Abstract:
    The purpose of the study was to evaluate the content of the «goals – objectives – methods – means» of state programs of the subjects of the Russian Federation related to the transport accessibility of territories, in accordance with the requirements of the program-oriented approach. To identify the problem area, the state programs of the subjects of the Russian Federation in the Far Eastern Federal District in the areas of development of the transport complex, transport system or transport infrastructure for compliance with the requirements of the main goal were taken. The SMART methodology was used to assess the compliance of government programs with the requirements of a program-oriented approach to management. The results of the SMART criteria assessment showed that the state programs adopted at the level of the subjects of the Russian Federation in the Far Eastern Federal District related to the transport accessibility of territories do not fully meet the criteria presented and have a number of disadvantages.

    Abstract:
    The article presents the author's view on the relevance and feasibility of developing communicative competence of participants in the educational process in the era of digitalization of the education system. At the same time, based on the study and analysis of existing interpretations of the concepts of "communication" and "competence", an interpretation of the category of "communicative competence" is proposed within the framework of communications, communities and connections existing in digital education. Based on the content of the formulated definition of the category of "communicative competence", an attempt is made to form a set of the main components or elements of this category. Without denying that achieving communicative competence by all participants in the educational process is currently an objective necessity, both the tools and mechanisms used to develop communicative competence and the technologies implemented in the Moodle LMS and the Yurait OP are presented.

    The creation of added value in early industrialized countries is currently defined by the transition to the fourth stage of industrialization, known as Industry 4.0. This development follows the third industrial revolution, which began in the early 1970s and relied on electronics and information technologies to achieve a high level of production automation.     The paper attempts to dive into the problem of the formation of a possible person from the position of the transdisciplinarity of the existing knowledge about a single substance (B. Spinoza), cognizability of the world (I.M. Sechenov), personality and society (N.A. Berdyaev), man in culture (M.K. Mamardashvili, V.P. Zinchenko), the problem of the ideal (E.V. Ilyenkov), objectivity and subjectivity of consciousness (M.M. Bakhtin, G.G. Shpet), as well as cultural-historical, activity paradigms of human mental development (L.S. Vygotsky, A.R. Luria, A.N. Leontiev, etc.), cultural-analytical approach. Since the truth, according to M.M. Bakhtin, is fundamentally incompatible within the limits of one consciousness, we invited outstanding thinkers of the past and present from various fields of science and art to a correspondence dialogue. After all, truth is always eventful, it is born at the point of contact of different consciousnesses. The limitations of scientific concepts in understanding the essence of the movement of a holistic person to a possible person are overcome by the presence of living metaphors in the text. The starting point in the reasoning is the thesis about the vital bodily-spiritual unity of a child who naturally lives simultaneously in the past, present, future, real and imaginary worlds, endowed with the main passion of a person – to be, to be fulfilled, to take place. The main issue discussed in the article is the possibility of a child reaching the ultimate state, striving for which he can become a possible person, able to form himself personally, despite any external circumstances (M.K. Mamardashvili), that is, constantly in various activities and actions to perform an act of surpassing himself. A number of arguments are given in favor of this. Among them: the presence of unlimited development potentials in the newborn in the form of fused sensory-emotional-motor reactions (innate reflexes) and extreme sensitivity to environmental influences, thanks to which the child is able to accept any trajectory of development under the influence of a «humanized and humanizing environment»; the appearance of elements of thought from feeling; the emergence of memory – the primary fact of personality, and the unity of universal and individual consciousness associated with it, familiarization with the material Universe – from its timeless beginning to its timeless end; substantiation of the thesis that a person is not a set of functions, and a certain dynamic integrity of a person means that the main thing in teaching and upbringing is, based on the natural biological laws of development, the introduction of the child with universal values in joint – dividing activity, Intermediary Action in terms of B.D. Elkonin [17; 29; 38; 39], stimulating living acts that contribute to the manifestation of the student's abilities and efforts of a historical person embedded in a cultural subject; his comprehension of the meaning of life situations, their creative understanding, the emergence of an experience of the responsibility of an act as the first phenomena of possible human development.

    Abstract:
    The article is devoted to the problem of the full treatment of the subject “Construction of Lyapunov functions” in the “Lyapunov's direct method” section in the courses on system dynamics, differential equations, etc., for students of mathematical and technical specialties. The authors of the article point out that first of all Lyapunov function method is considered the method useful for studying dynamics of concrete technical systems by mathematical methods. Since for practical use of this method it makes sense to construct Lyapunov functions in simplest form, the methodology for constructing Lyapunov functions in positive definite quadratic forms with given properties, certain features of original problems is proposed by the authors.
