    Abstract:
    The article is dedicated to a comprehensive analysis of the judicial procedure for declaring a citizen incapacitated in the Russian Federation. It examines both the substantive and procedural aspects of this institution. The key criteria for incapacity (medical and legal) established by civil legislation are explored, and the procedure for judicial proceedings is described in detail in accordance with the norms of the Civil Procedure Code of the Russian Federation. Special attention is given to the role of forensic psychiatric examination, the legal status of applicants, and the mandatory involvement of guardianship and custody authorities.

    The relevance of the topic is due to the need for a detailed consideration of the main provisions of the civil procedure in order to develop forms and ways to improve the current civil procedure. The chapter describes some theoretical and legal aspects of the study of the problems of civil procedure improvement. The analysis of the positions of scientists contained in the scientific literature devoted to the study of issues related to the improvement and modernization of civil procedure is carried out. The necessity of improving procedural issues in civil procedure during the preparation and consideration of a case is substantiated.
