- This article presents a comprehensive study of the evolution of contractual mechanisms in intellectual property law, focusing on the historical context of the formation and development of contractual regulation in this sphere, as well as on contemporary trends and legislative changes. The article examines the historical transition from standardized contractual constructions to the fundamental principle of freedom of contract. This principle, as a fundamental category of civil law, has been subjected to thorough study and rethinking across various historical epochs, which has determined its dynamic development and adaptation to changing socio-economic conditions. A special place in the study is occupied by the analysis of the Soviet period, characterized by a significant restriction on the application of the principle of freedom of contract due to the dominance of the planned administrative economy. - The chapter examines the legal aspects of using content generated with the assistance of artificial intelligence technologies in commercial activities. Particular attention is paid to issues of authorship and ownership of exclusive rights to intellectual property objects created with the participation of AI systems, as well as to the legal challenges of commercial exploitation of AI-generated content. The study analyzes risks associated with copyright infringement, trademark violations, protection of confidential information, and trade secret regimes. Special emphasis is placed on the role of human creative contribution as the key criterion for copyright protection of AI-assisted works. The paper also explores contractual mechanisms for risk allocation among business participants and addresses the use of artificial intelligence tools by employees and contractors. The authors conclude that effective and legally secure use of AI-generated content requires not only compliance with intellectual property legislation but also the implementation of internal corporate policies aimed at risk management and protection of business interests.

- The authors of the article note the fact that modern judicial practice on compensation for damage for the illegal distribution of intellectual property objects on the Internet is characterized by a desire to unify approaches, strengthen requirements for the identification of objects of violation and expand the use of compensation mechanisms. At the same time, the authors conclude that at the moment there are still problems related to the assessment of the amount of harm, as well as the need for regulatory clarification of the criteria for calculating compensation for violations committed in the digital environment.

- The article examines modern legislative approaches aimed at maximizing the protection of the rights of authors, patent holders, and other intellectual property owners. The authors note that effective protection of intellectual property on the Internet requires international cooperation and further modernization of the legal framework to adequately respond to rapidly evolving technologies and digital threats. The authors conclude that the civil law regulation of intellectual property objects on the Internet is a complex process that requires taking into account the specific features of the digital environment. The Internet, as a global networked information space, poses its own challenges to the legal protection of intellectual property due to the widespread distribution of content and the difficulties of global control and identification of infringers.

Legal aspects of judicial protection of exclusive rights to digital assets

- Abstract:
- The article is devoted to the study of legal conflicts arising in the context of judicial protection of exclusive rights to digital assets. The author analyses the peculiarities of qualification of such objects as cryptocurrencies, big data, 3D models and virtual game property, based on Russian and foreign judicial practice. The case of VKontakte v Double Data (2021) is considered, demonstrating the contradictions between the extraterritoriality of digital assets and the territoriality of jurisdictions. Particular attention is paid to the problem of distinguishing digital assets from intellectual property, as well as the dual status of virtual property. Finally, a classification of digital assets into three categories is proposed: protected intellectual property, virtual gaming property and crypto-assets. It emphasises the need to adapt legal norms to digital realities while maintaining a balance between innovation and protection of rights holders.
