    Abstract:
    The article examines the specifics of protecting exclusive rights to photographic works on the Internet amid mass circulation of digital visual content and the ease of reproducing images. It analyzes typical infringement patterns (copying, website posting, use in design and infographics), key evidentiary issues and the preservation of digital traces, as well as limits of free use—primarily in the context of quotation and the unlawful “illustration” of third-party materials. Drawing on current judicial approaches and clarifications by higher courts, the article proposes measures to improve enforcement while maintaining a balance between rights holders and Internet users.

Анализируются ключевые аспекты, такие как легкость копирования и распространения изображений в интернете, а также сложные вопросы идентификации авторства и нарушений прав. Обсуждаются существующие правовые механизмы, их эффективность и недостатки, а также необходимость адаптации законодательства к новым условиям. Особое внимание уделяется последствиям, с которыми сталкиваются фотографы и творческие профессионалы, и предлагаются возможные пути решения данных проблем.
