    Abstract:
    В статье рассматриваются особенности назначения наказания за взяточничество, предопределенные имущественной конструкцией санкций ст. 290 УК РФ: кратный штраф исчисляется от суммы взятки, а не от вреда, а выбор основного наказания решает судьбу дополнительного. На материале обобщения отказов в наложении ареста обосновывается вывод: имущественная часть наказания предопределяется не приговором, а полнотой обеспечительной работы на стадии расследовании.
