  • Constitutional and legal status of judges in the Russian Federation

    Abstract:
    The judiciary in Russia is not just one branch of the state system, but an institution that must ensure that conflicts between citizens and the state are resolved in accordance with the law, not at the discretion of an official. In this structure, the judge occupies a unique position: they are obliged to follow the letter of the law, but at the same time must take into account the real consequences of their decisions for specific people. This gives rise to a special architecture of their status – they must be protected from external pressure, but at the same time remain accountable to society and the law. In recent years, the legal status of judges has come into the focus of several interrelated processes. The 2020 amendments to the Constitution changed the procedure for forming a number of judicial bodies, which affected both the appointment mechanisms and the role of the judicial community bodies. At the same time, public demand for transparency in the justice system is growing: citizens expect the process of making judicial decisions to become more transparent, and for accountability for mistakes to be real. In addition, in the professional community, the gap between formal guarantees of independence and their practical implementation is being discussed more and more actively. The subject of analysis in this work is not the list of judges’ rights and obligations per se, but how these norms are implemented in specific procedures – from the selection of candidates to disciplinary liability. Special attention is paid to gaps and contradictions that reduce trust in the judicial system and hinder a judge’s independent work.

    В статье исследуются конституционно-правовые границы внедрения технологий искусственного интеллекта в судебную систему Российской Федерации. Анализируется соответствие алгоритмизации судопроизводства фундаментальным принципам правосудия – независимости судей, непосредственности судебного разбирательства, права на справедливое судебное разбирательство. Рассматриваются международные этические стандарты. На основе сравнительного анализа предлагаются критерии допустимого использования ИИ в судебной деятельности и обосновывается необходимость законодательного закрепления принципа «human-in-the-loop» (человек в контуре управления) как конституционной гарантии.

Автор анализирует первые проявления данного принципа в религиозных и правовых источниках древности, его развитие в российском законодательстве начиная с Судебника 1497 года, реформ Петра I и Александра II, а также особенности его реализации в советский период. Особое внимание уделено современному этапу становления независимости судей после принятия Конституции 1993 года, а также влиянию реформ на доступность правосудия в России.
