    Abstract:
    The study is devoted to the analysis of the relationship between the motives of learning, measured by two methods based on different theoretical approaches, with the main regulatory processes (planning, modeling, programming, evaluation of results) and regulatory and personal properties (flexibility, independence), as well as with students' self-reports on academic performance. The study used the following methods: «Diagnostics of students' learning motivation» (Badmaeva, 2004), «Scales of academic motivation» (Gordeeva, Sychev, Osin, 2014), «Style of self-regulation of behavior – SSP-98» (Morosanova, 2000) and self-report of students on their academic performance over the past semesters. The study was conducted using an online survey in a Google form on a sample of 82 university students aged 18–29 years. Correlation analysis (according to Spearman) and factor analysis (with Varimax rotation) were used in data processing. The results of the study: multiple significant correlations of learning motives, measured by two different methods «Diagnostics of student learning motivation» and «Scales of academic motivation», with scales of the SSP-98 methodology were obtained; significant positive correlations of learning motives with self-report on academic performance allow us to analyze the types of students' activities that include learning activities, that requires the use of already developed educational technologies and the development of new ones in the educational process at the university.

    Abstract:
    The chapter provides information on the global dynamics of copper production and consumption. It is shown that the demand for metal will increase in the near future due to the development of new industries, such as the production of electric vehicles and renewable energy technologies. Russia is a major player in this market, particularly in the production of refined copper. Copper exports are more than twice as large as domestic consumption. Almost half of the refined copper produced is exported. However, it is noted that both the domestic copper ore mining and processing market and the copper production market are these with a high level of economic concentration, i.e. oligopolized markets, where several large companies operate, and the share of the rest is insignificant. Such markets are usually characterized by high entry barriers and underdeveloped competition. It is difficult for small enterprises to survive in such conditions and they stop their work, being subjected to mergers, acquisitions, and bankruptcy. The research used general theoretical (analysis, synthesis, analogy, generalization and classification) and particular (observation, comparison, measurement and description) methods. The main object of the study is the copper turnover in Russia. To analyse the competitive advantages, foreign countries that occupy leading positions in this turnover are considered.

    Abstract:
    The chapter provides a comparative description of the concepts of economic growth and economic justice, and proposes indicators that characterize them. A forecast of the dynamics of economic development indicators was constructed using the extrapolation method until 2027, which gave a steady downward trend in growth. To prevent negative trends in economic development, measures of government influence on the economy are proposed, which should be carried out in three stages: determining the goals of economic development; analysis of the strengths and weaknesses of socio-economic relations within the country, as well as threats and opportunities from foreign counterparties; implementation of existing advantages into active moves and the formation of new ones. It is concluded that the successful socio-economic development of Russia should lead it to the establishment of social justice. An analysis of various approaches to the definition of the concept of «social justice» is made.

    In connection with the introduction by unfriendly countries of a new package of economic sanctions against the Russian Federation, in 2022, in order to reduce the negative impact of sanctions on the country's economy, the legislator implemented a number of anti-sanctions tax regulation measures. Within the framework of the conducted research, a set of scientific methods was used, including general research methods (generalization, comparison, description, etc.) general scientific (dialectical, logical, systemic, functional), private scientific (statistical, synergetic, etc.), special (comparative legal, formal legal, expert legal, etc.). In the course of the research, the author analyzes and evaluates the anti-sanction tax measures used in 2022, identifies problems of their practical application, and suggests appropriate solutions.

    This study is devoted to the study of the fundamentals of legal regulation of the institute of insolvency (bankruptcy) in Russia, as well as the role of the state in the regulation and implementation of this institution. The author considers the system of normative legal acts and acts of interpretation operating in the field of insolvency (bankruptcy), the main directions of state policy, tasks and functions of public authorities directly involved in the implementation of legislation on insolvency (bankruptcy). During the study of these issues, the author analyzed scientific literature, judicial practice, as well as materials of judicial statistics showing trends in the development of the institute of insolvency (bankruptcy) in Russia and the practice of its application. Based on the analysis, conclusions are drawn about the need to improve the regulatory framework of this institution, including taking into account the adjustment of the distribution of functions between public authorities, which will increase the effectiveness of the implementation of bankruptcy procedures in practice.

    The correct selection of elements in the legal composition is the most important part of the problem of choosing the most optimal option for regulating public relations. One of the negative aspects of the implementation of legal regulations is often defective legal facts or compositions that prevent the further implementation of the legal relationship or entail other negative consequences in the legal system. This article examines the significance of defective facts in the mechanism of legal regulation, determines their negative role in destabilizing the operation of legal norms, in failures of the law enforcement process, in violation of the rights and legitimate interests of participants in public relations.     Значительная часть существующих экономических школ связывает развитие экономики государства с возникновением новых предприятий малого и среднего бизнеса. При этом законы экономической конкуренции, значительное изменение структуры рынка, регуляторные меры и т. д. могут приводить к изменению количества таких предприятий в силу «естественных» причин (прибыльность/убыточность предприятия, растущий/стагнирующий рынок, простота/сложность финансовой отчётности и т. д.). Таким образом, для каждого государства на определенном этапе его историко-экономического развития существует определённое количество организаций, которые могут одновременно сосуществовать на его территории. Для принятия управленческих решений на уровне выработки стратегии развития государственной экономики (например, выбор между оказанием поддержки малому бизнесу или поддержкой процессов укрупнения предприятий и организаций) необходимо не только знать, каково актуальное количество предприятий, но и осуществлять прогнозирование динамики их численности на ближайшую перспективу. Построению соответствующей прогностической модели посвящено данное исследование.

  • Sources of Formation of Legal Positions of Russian Highest Judicial Bodies

    The present study is devoted to determining the place and role of legal positions of higher judicial bodies of Russia (judicial legal positions) in the mechanism of legal regulation. Let us specify in advance that the author means the Constitutional Court of the Russian Federation, the Supreme Court of the Russian Federation and the Supreme Arbitration Court of the Russian Federation (taking into account the 2014 amendments made to the legislation concerning the liquidation of the Supreme Arbitration Court of the Russian Federation) as the higher judicial bodies of Russia. Establishing the meaning and role of judicial legal positions in the mechanism of legal regulation is carried out by the author of this study through the analysis and demonstration of the main sources of formation of legal positions of the Constitutional Court of the Russian Federation, the Supreme Court of the Russian Federation and the Supreme Arbitration Court of the Russian Federation. In this regard, the author of this work identifies as sources of formation of judicial legal positions: legal and non-legal. Non-legal sources of formation of legal positions of the highest courts of Russia differ from the legal ones in the fact that initially they do not have material expression, exist in the abstract, however, have no less importance for the process of formation of judicial legal positions. To the legal sources of creating legal positions of the highest judicial bodies of Russia the author includes: formal sources of law, current legal practice, legal doctrine. As non-legal sources of formation of legal positions of the Constitutional Court of the Russian Federation, the Supreme Court of the Russian Federation and the Supreme Arbitration Court of the Russian Federation are: the inner conviction of a judge and professional legal consciousness of a judge. The author of this scientific research consistently reveals the importance and role of each source of formation of judicial legal positions. The conducted study of the most significant sources of formation of judicial legal positions allowed to better understand the place of legal positions of higher courts of Russia in the legal system and their role in legal regulation, which is reduced not just to the interpretation of judicial acts, but also to the formation of new legal provisions, which ultimately form a uniform judicial practice. Methodological basis of the study consisted of: analysis, synthesis, comparative-legal method, deduction, induction and other ways of knowledge used in science. Scientific conclusions and proposals contained in this work may serve as a basis for further theoretical study of the problems of judicial legal positions and used in the activities of legislative and law enforcement bodies.

    Abstract: In the course of the study of the problems of legal regulation of the ethno-conflict sphere, the author of the article conducted a survey (using the methods of questionnaires and in-depth interviews) of 20 experts who are highly qualified specialists in the field of countering ethno-national conflicts, studied the results of mass sociological research, analyzed scientific works and media publications. As a result, the most effective legal measures for regulating the prevention and suppression of ethnic and national conflicts were identified, and the main directions for their improvement in the interests of strengthening the Russian statehood were identified.

    The actual problem of our time at the enterprises of the Kuzbass coal industry is the moment of ensuring the psychological security of the employee's personality. The aim of the study is to consider the importance of self-regulation of the individual as a condition for ensuring the safety of the subject of professional activity.     This article deals with the current state and development of the economic mechanism of private enterprise in Kazakhstan. Recent trends have been identified in the economic mechanism of private enterprise, based on the application of scientific knowledge, comparison, analysis and systems approach. The result of the study is the formulation of the strengths and weaknesses of small and medium-sized enterprises and the advantages and disadvantages of the state and integration subsystem of the economic mechanism of private entrepreneurship, providing various support measures and contributing to sustainable economic development of the government. The unfavourable trends that have been identified will help to substantiate the main directions for improving the efficiency of small and medium-sized businesses in the country.
